Terms of Service

1. Who we are and acceptance

These terms govern the use of FoldBack, the management dashboard for recording studios available at app.foldback.io, provided by FoldBack. You can reach us at hola@foldback.io.

By creating or using an account you accept these terms and the Privacy Notice. If you use FoldBack on behalf of a studio or company, you confirm you are authorized to accept them on its behalf.

2. The service

FoldBack helps you run your studio: sessions, calendar, clients, projects, audio deliveries, proposals, billing, finances, team and inventory, among other features that may change or grow over time.

It is a management tool. It does not replace accounting, tax or legal advice, and the documents it generates (receipts, statements, proposals) are not official tax invoices.

3. Your account

You are responsible for keeping your password secure and for everything done from your account. Let us know right away if you suspect unauthorized use.

Your account information (studio name, email, contact and tax details) must be accurate and kept up to date.

4. Subscription, payments and cancellation

FoldBack is offered as a monthly subscription. The price, currency and applicable taxes are shown before you subscribe. The subscription renews automatically every month until you cancel.

You can cancel at any time. Cancellation takes effect at the end of the period already paid: until then you keep using FoldBack normally. There are no full or partial refunds for the current month.

If we change the price, we will notify you at least 30 days in advance; the new price applies from the next renewal.

If a payment fails, we may suspend access until it is resolved. Your data is kept as described in section 11.

5. Acceptable use

You may not use FoldBack to: upload or share illegal content or content you don't have rights to; send malicious software; try to access other studios' accounts, data or files; overload or attack the service; or resell or sublicense access.

We may remove content or suspend accounts that break this section, notifying you unless the law or urgency prevents it.

6. Your content and your clients' data

Everything you upload and record (data, audio, photos, documents) remains yours. You only give us the permission needed to store it, process it and show it to you and to the people you choose to share it with (for example, through a delivery or proposal link).

For the personal data of your clients, staff and suppliers, you are the controller and FoldBack acts as your processor: we handle it only to provide the service and following your instructions. It is up to you to inform them how you use their data and to have the rights to the materials you upload.

Please don't store sensitive personal data (health, ethnicity, beliefs, full banking details, etc.) in notes or other fields.

7. Availability and backups

We make reasonable efforts to keep FoldBack running at all times, but we don't guarantee it will be free of interruptions or errors. There may be maintenance windows, announced whenever possible.

We recommend downloading your data backup regularly (Settings → Backup) and keeping your original files: FoldBack does not replace your own project archive.

8. Artificial intelligence features

Some optional features, such as drafting proposals, use an external artificial intelligence provider. Only what is needed for that task is sent. Always review the result before using it: it may contain mistakes.

9. FoldBack's property

FoldBack's software, design, brand and own content belong to us. These terms give you no rights over them other than using the service while your account is active.

10. Liability

To the extent permitted by law, FoldBack is not liable for indirect damages, lost profits or data loss arising from the use of, or inability to use, the service, and our total liability is limited to what you paid in the 12 months before the event giving rise to it.

Nothing in these terms limits rights the law grants you that cannot be waived.

11. Suspension, termination and data retention

You can cancel your account at any time. We may suspend or terminate it for non-payment or for breaking these terms.

After the account ends, we keep your data and files for 90 days so you can download them or reactivate the account. After that they are permanently deleted, except what the law requires us to keep.

12. Changes to these terms

We may update these terms. If the change is significant, we will notify you inside FoldBack and ask you to accept it before continuing to use the service. The date of the current version appears at the top.

13. Governing law

These terms are governed by the laws of Mexico. Any dispute will be resolved before the competent courts of Mexico, without prejudice to any non-waivable rights granted by the law of your country of residence.
